These Terms and Conditions (“Terms”) govern the use of the Azhaar Flowers website and the purchase of products through it. By accessing this website and placing an order, you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use this website.


1. Company Information

Azhaar Flowers, Sherry Street, Opposite Nas Café, Off Al-Madras Street, Red Sea Governorate, Hurghada, Arab Republic of Egypt. 

All correspondence must be made through the contact details provided on our website.


2. Eligibility & Contract Formation

2.1 By placing an order, you confirm that:

  • You are at least 18 years old. 
  • You have legal capacity to enter into a binding contract.
  • All information provided is accurate and complete.

2.2 A legally binding contract is formed only when:

  • Payment has been successfully processed, and
  • An order confirmation email has been issued.

2.3 We reserve the right to refuse or cancel any order at our sole discretion.


3. Orders & Payment

3.1 All orders must be placed via the website.

3.2 It is the customer’s responsibility to provide:

  • Correct recipient name
  • Accurate and complete delivery address
  • Valid recipient contact number
  • Correct delivery date and selected time window

3.3 Orders will not be prepared until full payment has been successfully received.

3.4 We reserve the right to cancel orders in cases of:

  • Failed payment authorization
  • Suspected fraud
  • High-risk transactions
  • Obvious pricing errors

4. Pricing

4.1 All prices displayed are subject to change without notice.

4.2 The price applicable is the price shown at checkout.

4.3 In the event of a clear pricing error, we reserve the right to cancel the order and issue a refund.


5. Same-Day Delivery

5.1 Same-day delivery is available for orders placed by 9:00 PM (local time), subject to availability and operational capacity.

5.2 During peak floral periods (including Valentine’s Day, International Women’s Day, Mother’s Day and major holidays), delivery schedules may be adjusted.

5.3 Same-day orders cannot be cancelled once preparation has commenced.


6. Delivery Policy

6.1 Free Delivery in Hurghada

Free delivery applies within Hurghada city limits only. Additional charges may apply for remote or restricted areas.

6.2 Delivery Time Windows

Customers may select a preferred delivery time from available options at checkout.

Selected time windows are estimates and are not guaranteed exact-time appointments.

We are not liable for delays caused by:

  • Traffic conditions
  • Weather
  • Security procedures
  • Recipient unavailability
  • Access restrictions
  • Force majeure events

7. Hotel & Resort Delivery Disclaimer

7.1 For deliveries to hotels, resorts, serviced apartments, or gated compounds, the customer is solely responsible for ensuring that:

  • The recipient is a registered guest
  • The hotel permits flower deliveries
  • Correct room number and full guest name are provided

7.2 Where delivery is made to hotel reception, concierge, security personnel, or any authorised hotel representative, this shall constitute full and final delivery fulfilment.

7.3 Responsibility transfers to the hotel or authorised third party immediately upon handover.

7.4 Azhaar Flowers shall not be liable for:

  • Delays in room delivery by hotel staff
  • Loss, theft, or damage after reception handover
  • Refusal by hotel staff to accept delivery
  • Hotel policies restricting access

7.5 No refund shall be issued where delivery has been confirmed at hotel reception in accordance with the delivery address provided.


8. Recipient Unavailability

8.1 If the recipient is unavailable, we may:

  • Leave the order with a neighbour, security, or reception
  • Leave the order in a safe location
  • Contact the recipient directly

8.2 If delivery fails due to incorrect information provided by the customer, no refund will be issued.

8.3 Re-delivery may incur additional charges.


9. Product Availability & Substitution

9.1 Flowers are seasonal and subject to availability.

9.2 We reserve the right to substitute flowers, packaging, or containers with items of equal or greater value while maintaining the overall style and colour theme.

9.3 All arrangements are handcrafted. Images on the website are illustrative only.

9.4 Variations in bloom size, stage, colour shade, or arrangement style do not constitute defects and are not grounds for refund.


10. Cancellations & Amendments

10.1 Orders cancelled more than 24 hours before delivery are eligible for a full refund.

10.2 Orders cancelled within 24 hours of delivery may not be refundable.

10.3 Same-day orders cannot be cancelled once preparation has begun.

10.4 Amendments to address or date must be requested at least 24 hours in advance.


11. Refund & Complaint Policy

11.1 Due to the perishable nature of flowers, complaints must be submitted within 24 hours of delivery.

11.2 Complaints must include clear photographic evidence.

11.3 Refunds or replacements may be issued only in cases of:

  • Proven non-delivery due to our error
  • Confirmed significant quality defects

11.4 Refunds will not be granted for:

  • Minor aesthetic variations
  • Personal taste dissatisfaction
  • Substitutions made in accordance with these Terms
  • Delivery delays within reasonable operational limits

11.5 Approved refunds will be issued via the original payment method only.


12. Perishable Goods Disclaimer

Flowers are perishable products.

We are not responsible for deterioration caused by:

  • Improper care
  • Exposure to heat or direct sunlight
  • Failure to add water
  • Delayed unpacking

13. Force Majeure

We shall not be liable for failure or delay caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Civil unrest
  • Transport disruption
  • Supply chain interruption
  • Power outages

14. Chargebacks & Payment Disputes

14.1 By placing an order, the customer confirms they are the authorised cardholder or have authorisation to use the payment method.

14.2 In the event of a chargeback, we may provide to the payment processor:

  • Order confirmation
  • Delivery confirmation
  • GPS or photo evidence
  • Communication records
  • IP address data

14.3 Delivery confirmation to the address provided by the customer constitutes full contractual fulfilment.

14.4 Initiating a chargeback where delivery has been completed in accordance with these Terms constitutes breach of contract.

14.5 We reserve the right to:

  • Recover funds
  • Recover administrative costs
  • Refuse future orders
  • Report suspected fraud

15. Limitation of Liability

15.1 Our liability is strictly limited to the value of the purchased product.

15.2 We shall not be liable for indirect, incidental, or consequential losses.

15.3 We are not liable for emotional distress or subjective dissatisfaction.


16. Intellectual Property

All website content including images, branding, text, and design elements remain the property of Azhaar Flowers and may not be reproduced without written consent.


17. Data Protection

Personal data is processed solely for order fulfilment and operational purposes in accordance with our Privacy Policy.


18. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Egypt.
